Drainage petition projects are conducted under Sections 6131, 6133, and 6137 of the Ohio Revised Code. This law allows a landowner or group of landowners to petition the County Commissioners to construct drainage improvements on the landowners’ behalf and to maintain those projects in perpetuity. All costs for drainage projects are paid by the affected landowners through a special assessment applied to real estate taxes.
The Delaware SWCD, through our partnership with the Delaware County Engineer and Delaware County Commissioners, handles many administrative and technical aspects of these projects, including survey, engineering design, construction supervision, and maintenance.
